1. The Promoter
1.1 The promoter is The Curious Octopus, (“the Promoter”).
1.2 The Promoter’s website is www.thecuriousoctopus.co.uk.

2. The Prize Draw
2.1 These terms and conditions apply to the Surprise Halloween Guveaway (“the Prize Draw”).
2.2 The Prize Draw opens on 20th September (“the Opening Date”).
2.3 The Prize Draw closes at 1pm on 15th October (“the Closing Date”).
2.4 Entries received before the Opening Date or after the Closing Date will not be accepted.
2.5 Entry is free and no purchase is necessary.
3. Eligibility
3.1 The Prize Draw is open to residents of the United Kingdom aged 18 or over.
3.2 The Prize Draw is not open to:
● the Promoter or members of the Promoter’s immediate family or household;
● employees, agents or suppliers of the Promoter who are professionally connected with the Prize Draw; or
● anyone directly involved in organising or administering the Prize Draw.
3.3 The Promoter may request proof of age, identity, residency and eligibility before awarding the prize.
3.4 If an entrant is unable to provide satisfactory proof of eligibility, the Promoter may disqualify the entry and select another winner.
4. How to Enter
4.1 To enter the Prize Draw, entrants must:
● visit www.theCuriousOctopus.co.uk/pages/halloween-giveaway
● complete the online entry form with their name and a valid email address; and
● submit the completed form before the Closing Date.
4.2 Only one entry per person is permitted unless the promotional material clearly states otherwise.
4.3 Entries made using multiple names, email addresses, identities or accounts in an attempt to exceed the entry limit will be disqualified.
4.4 Entries submitted by automated systems, bots, third parties, agents, organised groups, macros or other automated methods will not be accepted.
4.5 Entries that are incomplete, illegible, corrupted, fraudulent, submitted incorrectly or do not comply with these terms and conditions will not be accepted.
4.6 Proof of submitting an entry is not proof that the Promoter received it.
4.7 The Promoter accepts no responsibility for entries that are lost, delayed, misdirected, incomplete or not successfully submitted because of a technical fault, equipment failure, network failure, website failure or any other reason outside the Promoter’s reasonable control.
5. Email Marketing
5.1 Entrants are not required to agree to receive marketing emails in order to enter the Prize Draw.
5.2 Any option to receive news, offers and marketing emails from The Curious Octopus is separate and voluntary. Choosing not to receive marketing will not affect an entrant’s chances of winning.
5.3 Entrants who choose to receive marketing emails may unsubscribe at any time by using the unsubscribe link included in an email or by contacting the Promoter.
6. The Prize
6.1 There is one prize available.
6.2 The prize is random selected Halloween themed stock up to value of £30
6.3 The approximate retail value of the prize is £30.
6.4 Unless expressly stated otherwise, the prize does not include any additional products, expenses or costs.
6.5 The prize is non-transferable, non-refundable and cannot be exchanged for cash.
6.6 The winner may not sell, auction or transfer the prize to another person before receiving it.
6.7 The Promoter reserves the right to replace the prize with an alternative prize of equal or greater value if circumstances outside the Promoter’s reasonable control make this necessary.
6.8 Product colours, styles and packaging may vary from promotional photographs. Where the prize includes a randomly selected product or design, the selection made by the Promoter will be final.
6.9 Any age recommendations, safety information and instructions supplied with the prize must be followed. An adult must supervise a child’s use of the prize where required.
7. Winner Selection
7.1 A winner will be selected at random from all valid entries received before the Closing Date.
7.2 The draw will take place within 2 days of the Closing Date.
7.3 The winner will be selected using a verifiably random computer process or under the supervision of an independent person.
7.4 The result of the draw is final. No correspondence will be entered into regarding the selection of the winner, except where the Promoter considers this appropriate.
8. Winner Notification and Claiming the Prize
8.1 The Promoter will contact the winner using the email address supplied with their entry.
8.2 The winner will be contacted within 2 days of the draw.
8.3 The winner must respond within seven days of the Promoter’s first notification and provide the information reasonably required to confirm their eligibility and arrange delivery.
8.4 Entrants should check their email inbox and junk or spam folders after the draw.
8.5 If the winner:
● does not respond within seven days;
● cannot be contacted after reasonable attempts;
● is found to be ineligible;
● has provided false or inaccurate information;
● has broken these terms and conditions; or
● does not provide the information reasonably required to deliver the prize,
the winner will forfeit the prize and the Promoter may select a replacement winner at random from the remaining valid entries.
8.6 The replacement winner will be subject to the same eligibility and claim requirements.
8.7 The Promoter will not ask a winner to make a payment or provide bank or payment-card details in order to claim the prize.
9. Prize Delivery
9.1 The prize will be sent to a valid UK postal address supplied by the winner.
9.2 The prize will normally be dispatched within 30 days of the winner confirming their details and eligibility.
9.3 The Promoter will pay the standard cost of delivering the prize to the winner’s UK address.
9.4 The Promoter is not responsible for delays caused by postal or courier services or other events outside its reasonable control.
9.5 The winner is responsible for ensuring that the delivery information they provide is complete and accurate. The Promoter will not be responsible for a prize that cannot be delivered because incorrect or incomplete information was provided.
9.6 If the prize is returned to the Promoter as undeliverable and the winner cannot be contacted within a reasonable period, the Promoter may treat the prize as forfeited.
10. Winner Information
10.1 The Promoter must be able to demonstrate that a valid prize was awarded.
10.2 The Promoter may make the winner’s surname and county available to anyone who contacts info@thecuriousoctopus.co.uk within 30 days after the Closing Date.
10.3 An entrant may object to their surname or county being published or may request that the amount of information published is reduced by contacting the Promoter.
10.4 Even if a winner objects to publication, the Promoter may still be required to provide the winner’s details and evidence of the valid award to the Advertising Standards Authority if requested.
10.5 The Promoter will not use the winner in promotional photographs, social-media posts or other publicity without obtaining their permission.
11. Personal Information
11.1 The Promoter will use entrants’ personal information to administer the Prize Draw, validate entries, contact the winner, deliver the prize and comply with its legal and regulatory obligations.
11.2 Entry information will not be used for email marketing unless the entrant has separately chosen to receive marketing communications.
11.3 Personal information will be handled in accordance with the Promoter’s privacy policy, available at www.theCuriousOctopus.co.uk/pages/the-curious-octopus-privacy-policy
11.4 Personal information collected solely for administering the Prize Draw will be retained only for as long as reasonably necessary for that purpose and to meet any legal or regulatory requirements.

12. Disqualification
12.1 The Promoter reserves the right to reject or disqualify an entry where it has reasonable grounds to believe that:
● the entrant has breached these terms and conditions;
● the entry is fraudulent, dishonest or otherwise invalid;
● the entrant has attempted to manipulate the Prize Draw;
● automated or unauthorised entry methods have been used; or
● the entrant’s conduct is contrary to the fair and proper running of the Prize Draw.
12.2 The Promoter’s decision concerning eligibility or disqualification will be final, subject to applicable law.
13. Changes or Cancellation
13.1 The Promoter may suspend, cancel or amend the Prize Draw where circumstances outside its reasonable control make this unavoidable.
13.2 The Promoter will not change the Closing Date unless circumstances outside its reasonable control make the change necessary and changing the date would not unfairly disadvantage anyone who has already entered.
13.3 If the Prize Draw is amended, suspended or cancelled, the Promoter will publish appropriate information on its website or through the channel originally used to promote it.
14. Liability
14.1 Nothing in these terms and conditions excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.
14.2 Subject to clause 14.1, the Promoter will not be responsible for loss, damage, disappointment or injury arising from entering the Prize Draw or accepting or using the prize where that loss was not reasonably foreseeable or was caused by circumstances outside the Promoter’s reasonable control.
14.3 The Promoter does not accept responsibility for any technical, website, network, hardware, software or communication failure that prevents an entry from being submitted or received.
14.4 Entrants’ statutory rights are not affected.
15. Social-Media Platforms
15.1 Where the Prize Draw is advertised or shared on Facebook, Instagram, TikTok or another social-media platform, it is not sponsored, endorsed, administered by or associated with that platform.
15.2 Entrants release the relevant social-media platform from responsibility for the administration of the Prize Draw to the extent permitted by law.
15.3 Any questions or complaints about the Prize Draw must be directed to The Curious Octopus and not to the social-media platform.
16. Acceptance of These Terms
16.1 By entering the Prize Draw, entrants confirm that they have read, understood and agreed to these terms and conditions.
16.2 The Promoter recommends that entrants save or print a copy of these terms and conditions.
16.3 These terms and conditions will remain available at www.theCuriousOctopus.co.uk//pages/halloween-giveaway throughout the Prize Draw.
17. Governing Law
17.1 These terms and conditions and any dispute arising from the Prize Draw are governed by the laws of England and Wales.
17.2 Entrants may bring legal proceedings in the courts of the country within the United Kingdom in which they live.
